Terms & Conditions

Please read the following Fox Cabinets Terms & Conditions as applicable to the following:
– All proposals, invoices and client agreements as produced by Fox Cabinets and agreed to by the Client;
– All products designed, manufactured, assembled and/or otherwise supplied to the Client;
– All materials, hardware, fixtures, fittings, accessories and appliances as supplied to the Client;
– All services and support carried out by, and on behalf of, Fox Cabinets as per agreed Proposal
– All professional trades, contractors, suppliers and services engaged by Fox Cabinets to carry out agreed works as per Proposal;
– Terms & Conditions as provided with proposal/quote are the only valid conditions to be referred to.

TERMS
1. Fox Cabinets, trades, suppliers and contractors request that clients ensure that all requirements are covered in the approved, and agreed to proposal prior to initial payment.
2. In the event of oversight, missing or incorrect items, Fox Cabinets:
a. Charges relate to work, supplies and materials only as stated on invoice and quotes.
b.Reserve the right to review original proposal details at any stage, prior to completion of agreed proposal works and final invoice payment.
c. If required, a variance invoice will be generated detailing the reason, additional costs and recommended steps taken to rectify such an occurrence.
d. If additional works, hardware, material or any such items are required to complete project all additional costs will be invoiced immediately with payment to be made within 12 hours of invoice sent to Client. If payment is not received, Fox Cabinets reserves the right to cease all works until payment is received.
3. Prices are valid for the term of the quote only and may vary if quote accepted after quote expiry date. Fox Cabinets reserve the right to modify proposal costs in the case of expired quote dates.
4. If chosen products, materials or hardware are unavailable or delayed, price differences will be calculated and either refunded or invoiced with payment to be made upon receipt of invoice.
5. Refund policy for change of mind must be advised by email within 48 hours of initial payment only;
6. Warranties – for hardware, materials, accessories and appliances as per supplier, contractor or trades.


CUSTOMISED CABINETRY AND JOINERY:
– Fox Cabinets endeavours to design, manufacture and supply all cabinetry and joinery as per client’s job brief and customised specifications.
– Clients will be provided design drawings, plans or other documentation to review and sign off on prior to manufacturing. Maximum two modifications to drawings included if requested by client.
– Charges of $110 per additional plan will be required if the changes are made by the Client. If the fault is due to Fox Cabinets misunderstanding absolutely no charges will be required.
– Fox Cabinets requests that examples and/or exact specifications are provided by the Client prior to completion and supply of customised cabinetry and joinery. Fox Cabinets agrees to work with clients in the event of miscommunication or misinterpretations made by Fox Cabinets.
– In the event of Flat Packed items, Fox Cabinets request that Clients bring an additional person to assist in loading of panels – please also bring appropriate protective wear for protection against rough cabinetry.
– In the event of Fox Cabinets installing cabinetry, we will endeavour to provide up to five (5) days’ notice, however may not be able to advise a set date until manufacturing of cabinetry commences.


RENOVATIONS / ON SITE WORKS
– “Onsite” refers to the location, or address, detailed in the client proposal as provided by the Client
– Initial designs, draft plans and pre-manufacturing/onsite works commencement process:
– Fox Cabinets will provide design concepts, drawings, plans and undertake check measures and site reviews with all appropriate and applicable parties.
– Services and works may not proceed until Client sign off is obtained or specifically required to proceed with agreed scope of works.
– Minimum four-hour charge for all onsite works and charged in blocks of four ongoing – please note that this will also include pickup of ‘change of mind’ items or additional delivery of items beyond the control of Fox Cabinets.
– Site Access – Client to facilitate access for on-site meetings with required trades, suppliers and contractors prior to commencement of agreed works.
– Fox Cabinets to liaise with, book and manage all trades, suppliers and contractors as required and on behalf of clients.
– Manufacturing – all cabinetry and joinery to be manufactured and installed by the Fox Cabinet team where applicable.
– Hardware and materials – all hardware and materials to be supplied and installed as stated within proposal.
– Accessories and appliances – supplied and installed as stated within proposal.
– Availability delays – Occasionally there are delays with products, hardware or material availability. Fox Cabinets will work with all suppliers to ensure that impact is as minimal as possible to customers. However, re-scheduling may be required.
– All payments made to Fox Cabinets are non-refundable after 48 hours of payments made.
– Customer supplied accessories, fixtures, fittings and appliances – customers must ensure that all specifications are provided to Fox Cabinets prior to manufacturing if modifications may be required prior to manufacturing and installation. If not provided to Fox Cabinets in a timely manner, additional costs may be incurred and invoiced to the customer.
– Fox Cabinets will assist in the installation of appliances such as ovens, cooktops, rangehoods, and dishwashers due to the certified works that are required to be completed.
– In the instance of fridges, washing machines, dryers etc, Fox Cabinets request that Clients be available to install these items themselves. In the event that Fox Cabinets assist in the installation of such items, Fox Cabinets will not be held responsible for any damage or issues resulting from the installation. We request that Clients endeavour to have these installed by third parties to avoid potential issues that may void warranties.
– Installation Scheduled – Fox Cabinets reserve the right to re-schedule the installation date at no additional cost to the customer.
– Installation Date Change – If client requires changes to scheduled installation date, Fox Cabinets will endeavour to work with the client to re-schedule within a reasonable time frame, however, may have limited availability. Clients are requested to advise Fox Cabinets of date changes within twenty-four (24) hours of installation date booked, and, to provide alternative installation dates if known. If, however, client is unable to re-schedule within one (1) week of original installation date, the client may incur an additional storage fee of $150 flat fee per week.
– Unforeseen Circumstances – Occasionally unforeseen circumstances can arise and all parties agree to communicate respectfully, openly and with the intent to facilitate completion of agree and stated works. If payments are agreed to be refunded, Fox Cabinets reserve the right to make staggered repayments at intervals that suit Fox Cabinets.
– Necessary Works – If, during works, additional, unidentified, urgent or unforeseen works are found to be required to proceed with works without delay – either by Fox Cabinets or, associated trades engaged by Fox Cabinets, the client:   
a. Will engage existing Fox Cabinets trades working on premises to proceed with said works if appropriate.   
b. Accepts that commencement of such works by Fox Cabinets and/or associated trades constitutes verbal agreement that has been sought and approved from the client;   
c. Fox Cabinets, trades, suppliers and contractors will provide a ‘ballpark’ quote prior to proceeding with the works to the best of their ability. However, if works exceed this quote, upon issuing of invoice, Fox Cabinets will detail additional charges, identify areas of difference and requests payment to be made.    d. Verbal, text, written or emailed communication of quotes are deemed as recognised by all parties.   
e. Invoice will be generated within 24 hours with payment required upon receipt of invoice. If payment is not received, Fox Cabinets will cease all works until payment received.
– Alternative options – If Fox Cabinets identify alternative, additional or improved options for clients, after initial invoice has been generated, Fox Cabinets will provide verbal quote. Invoice will be generated once additional costs have been confirmed with payment required upon receipt of invoice.
– Practical use of cabinetry and joinery, hardware, accessories – and all other products and services, by client, before final inspection sign off is completed, deems admission by the client that practical completion has been met. Payment will be expected as agreed.
– Final inspection of project works will be undertaken when works deemed completed as per proposal outline by Fox Cabinets. Final payment will then be required immediately. If final payment is not paid immediately late fees will be applied at a rate of 5% for every day payment has not be made.
– Issues with cabinetry and joinery after sign off or practical use will be handled as warranty request – once full payment has been made. Fox Cabinets will require the following:
– Details of issues to be emailed to tft@foxcabinets.com.au only.
– Video and/or photographic proof of issue to be sent with email.
– A scheduling link will be sent to the Client to book in a suitable time for review of issue.
– Phone calls and text messages are welcome to be made to alert Fox Cabinets to the issue, however, must be followed up with photo/video evidence and emailed outline of issue.
– If disputes arise, Fox Cabinets and associates’ trades reserve the right to cease agreed works until issue resolved.


ADDITIONAL WORKS
At time of works, often clients request additional works to be discussed, quoted and carried out at the same time or during the agreed works being undertaken by Fox Cabinets or associated trades and suppliers. Often such requests result in budget increases, extended and/or missed project end dates and adversely affect other clients and projects.
– If clients would like to request additional services, products or works, not within the agreed proposal, please email all requests to tft@foxcabinets.com.au or ian@globalbk.com.au . Fox Cabinets will then review, quote and identify when additional requests may be undertaken without impacting original scope of works timeframe.     
– Fox Cabinets respectfully request that clients do not request additional works, products or services from the Fox Cabinets team whilst they are onsite carrying out agreed works. Fox Cabinets retain the right to invoice accordingly if identified as required – payment upon receipt of invoice.     
– Fox Cabinets respectfully request that clients do not request additional works, products or services from the Fox Cabinets team, trades or suppliers whilst they are onsite carrying out agreed works during the day. Often these discussions are rushed, place undue pressure on the Fox team and trades and miscommunications occur more often than not. Please request to discuss additional works at the end of the working day so as to not impede timeframes.  
– If clients would like to request additional services, products or works, not within the agreed proposal, Fox Cabinets will then review, quote and identify when additional requests may be undertaken without impacting original scope of works timeframe.   
– Fox Cabinets requests that Clients respect that additional works may negatively impact Fox Cabinets, trades and suppliers who may have scheduled works, projects and agreements with other clients. At times additional works may not be able to be carried out during the agreed works and Fox Cabinets sincerely appreciate Clients who do not insist on additional works to be completed if it is deemed to be unviable to do so without adversely impacting other parties.
– Fox Cabinets and associated trades reserve the right to add surcharges for works not previously agreed to, are not necessary and are for convenience of the Client to have the works completed at the same time.
– Installation of accessories such as handles, tapware, doorknobs are quoted as a one off activity – in the case of Client change of colour, style or install type, Fox Cabinets will be invoicing for:
a. Additional/new hardware or accessories.
b. Additional time spent choosing and obtaining said items at a minimum charge of four (4) hours.
c. If cabinetry requires significant modifications as is often the case, Fox Cabinets will be invoicing for this under a ‘Change of Mind’ variance invoice to be paid immediately.
d. In the instance of change of mind for purchased items, if items cannot be swapped or replaced by suppliers, Clients will be given the additional and unnecessary items as well as the new items.


CONTACT AND AVAILABILITY
At times, Fox Cabinets have experienced multiple attempted phone and text contacts by Clients during the day for non-urgent issues – we respectfully request Clients to keep contact to a minimum during the business day as the team are either manufacturing, onsite with clients or in meetings. In the case of Fox Cabinets working on your project we request:
– All calls and texts to be made during business hours of 8am – 5.30pm only.
– Refrain from contacting outside of these hours, on weekends or public holidays unless otherwise agreed to be Ian Fox.
– If the issue is urgent and outside of these hours please text Ian on 0408 061 173 and we will respond immediately.
– If the issue is not urgent please feel free to email us at ian@globalbk.com.au or tft@foxcabinets.com.au and the issue will be dealt with when available.
In the case of works to be scheduled, proposals to be sent or general queries we request:
– Clients to call or text 0428 818 159 for one of the Fox team to respond to you.
– Email non-urgent queries to tft@foxcabinet.com.au
Fox Cabinets reserve the right to:
– Schedule days not on site in the event of renovations at no additional charge to the Client – these will be kept to the absolute minimum and generally only in the event of an emergency.
– Works on non-business days such as weekends, evenings or public holidays available upon request – additional rates will apply.
– Fox Cabinets reserve the right to work on non-business days as stated above without the Client being required to pay for additional rates.


MISCELLANEOUS
– At times, Fox Cabinets commits to ensuring that detailed job briefs, client meetings notes, and design documentation are carefully recorded and filed to ensure project outcomes are as discussed and agreed.
– Fox Cabinets request that photography and videos are able to be undertaken for before/during and after works are completed to be used on social media and the Fox Cabinets website. All identifying features, details or names will not be used publicly – if at any stage you are concerned, please call us immediately and we will remove or modify the video or images without questions.
– Fox Cabinets prides ourselves on referrals, word of mouth and testimonials to help sustain and grow our business – your testimonial would be greatly appreciated at the end of the project. These can be emailed to tft@foxcabinets.com.au , stated on our Facebook page or on Google – again please advise us if you wish your first names to only be used, initials only and if suburb is acceptable.
– If Clients successfully refer business to us we will always be grateful and will provide a small token of our appreciation.
– Details of job specifications, time frames and schedules will be communicated as our schedule allows.


PAYMENT PROCESS
Fox Cabinets implement staged payment plans to ensure that all materials, hardware, fixtures, fittings are ordered in a timely and efficient manner as agreed.
– Invoices will have either “Payment on Receipt” or stated business days to make payment.
– Late fees on invoices may incur a 10% late fee if due date not met within 20 business days.
– All invoices will be required to be paid as per stated terms on invoice.
 
PAYMENT SCHEDULE:
Payments to be made on the day invoice is generated – direct debit payment only.
 
SUMMARY
Proceeding with proposal indicates acceptance of all TERMS & CONDITIONS. Clients’ agreement to proceed with proposal, acceptance of invoices and/or payments made, indicate acceptance of Fox Cabinets Terms & Conditions.
